Terms & Conditions - Purchase Transaction

The acquisition of any product ("Product") or service ("Service") by as you (“User” or “you” or “your”) from Constant Practice LLC ("Constant Practice” or “Company” or “we” or “us” or “our”) either using the online retail store or directly from us is subject to these purchase transaction terms and conditions ("Purchase Terms"). By making a purchase, you acknowledge your agreement to these Purchase Terms.

    1. Product Descriptions. We work very hard to maximize the accuracy of our Product descriptions such as year, size, fitting, dimensions, materials, condition, color, model height and other similar attributes. However, we do not guarantee the absolute accuracy of the details. 

    2. Used Condition. Some items are in used condition and will show signs of wear.  Please see the condition description and note any defects as shown in item images. If there are any questions, please reach out before purchasing.

    3. Measurements. Unless expressly stated otherwise, all measurements are provided in inches. Although we try to hard to calculate accurate measurements, item measurements are estimates.

    4. Shipping. Shipping fees are provided. If the shipping fee materially changes from the amount listed, then customer is responsible for the applicable shipping fee. We will work with our customer to ship the Product in a mutually beneficial manner. 

    5. Returns and Exchanges. All transactions are final. We do not offer any returns, refunds or exchanges. 

    6. Warranties. All Products are sold As-Is and are not sold subject to any warranty. All warranties are expressly disclaimed. 

    7. Shipments.  We attempt to ship items as soon as possible. However, we do not guarantee specific shipment times.

    8. Shipping Rates: These rate options and insurance apply. If customer prefers different terms, then customer may add more shipping insurance and or a delivery signature if discussed and agreed with us prior to purchasing. Please message on Instagram or email before purchasing, so we can adjust the price accordingly based on the additional shipping request(s).

      1. Domestic: $15 USD Shipping option = UPS 3 Day Select (3 business days) - UPS shipping insurance is included with coverage of maximum of $100 USD. 

      2. International (Canada/France/UK): $40 USD Shipping option = UPS Worldwide (2-5 business days) - UPS shipping insurance is included with coverage maximum of $100 USD. 

      3. International (Canada/France/UK): $65 USD Shipping option = DHL Express Worldwide (2-5 business days) - All DHL Express international shipments, except those to Canada, require customer signature upon delivery with the added service included in the price. Shipping insurance is included with coverage maximum of $5,000 USD. 

      4. International (NON Canada/France/UK): $65 USD Shipping option = UPS Worldwide (2-5 business days) - UPS shipping insurance is included with coverage maximum of $100 USD.

      5. International (NON Canada/France/UK): $100 USD Shipping option = DHL Express Worldwide (2-5 business days) - All DHL Express international shipments, except those to Canada, require customer signature upon delivery with the added service included in the price. Shipping insurance is included with coverage maximum of $5,000 USD. 

  1. Sales Taxes.  When we are required to collect sales taxes, then you agree to pay the applicable sales taxes. 

  2. International Import Charges. We are required to accurately report actual Product purchase amounts and values on customs & import forms. We unfortunately cannot mark any Product as a "gift" or alter the item’s value.  An international purchase is subject to applicable import fees in the destination country. The customer is responsible to all import fees.  If the customer is unable to pay the import fees in a timely manner, then customer assumes all liability associated with the failure to pay including if the destination country refuse entry and returns the Product to us. If this happens, we may treat any returned Product as abandoned by the customer.  ALL SALES ARE FINAL.

  3. Limitation of Liability. If a Product description contains a material error, then in no event does our liability exceed the price paid by you for the Product. Our liability is limited to the amount you paid to purchase the Product.

  4. Jurisdiction. All transactions are deemed consummated, completed and performed at our facility located in Richmond, Virginia, USA.
